GENERAL TERMS AND CONDITIONS OF SALE (CGV)

1. Seller identity
Seller: Cristian Mitrani – Photographer / Visual Artist (“Seller”, “we”).

If the Seller operates through a registered business (SIRET/VAT or equivalent), the Seller’s registration details will be provided on the invoice/quote and shall prevail.

 

2. Scope
These CGV apply to the sale of photographic artworks and related products (e.g., prints, editions, framed works) sold by the Seller directly to customers (“Customer”, “you”), primarily by quote and order confirmation (email or written acceptance).
If a purchase is made through a third-party gallery, marketplace, or auction platform, that third party’s terms may apply in addition to (or instead of) these CGV.

 

3. Products
Artworks are described in the quote, including (where applicable) size, edition number, paper type, framing, and authenticity elements.
Because artworks can be handmade, limited, or produced in small series, minor variations may occur without affecting conformity.

 

4. Orders
4.1 Quote
Upon request, we provide a written quote describing the artwork, price, delivery fees (if any), and estimated lead time.

4.2 Order confirmation
An order becomes binding when we receive your written acceptance of the quote (email or signed document) and, where applicable, the required payment (deposit or full payment).

4.3 Custom / made-to-order works
If the artwork is made-to-order (custom dimensions, specific framing, personalized edition, or any clearly customized specification), it is treated as a customized product.

 

5. Prices
Prices are stated in EUR unless otherwise indicated.
Any applicable taxes (including VAT, if applicable) and delivery costs will be specified in the quote and/or invoice.

 

6. Payment
Payment terms are specified in the quote/invoice. Unless stated otherwise, payment is due before shipment.
Accepted payment methods will be indicated on the invoice (e.g., bank transfer or other agreed method).
The Seller reserves the right to suspend or cancel the order in case of non-payment.

 

7. Delivery
Delivery terms (carrier, address, timeframe, and costs) are specified in the quote.
Risk transfers to you upon delivery. You must inspect the package upon receipt and notify the carrier and us promptly of any visible damage, and provide supporting evidence (photos) where possible.

 

8. Right of withdrawal (consumers – distance sales)
If you are a consumer purchasing at a distance within the EU/EEA, you generally have a 14-day right of withdrawal starting from receipt of the goods, under applicable consumer rules.

Important exception: the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized (custom/made-to-order works), or other legal exceptions.

To exercise the withdrawal right (when applicable), you must notify us in writing within the legal timeframe at: art@themuisca.com
Returned goods must be in their original condition and packaging. Return shipping costs may be borne by the Customer unless otherwise stated in the quote/invoice.

 

9. Legal guarantees (consumers – France)
For sales governed by French consumer law, statutory legal guarantees may apply, including:
- Legal guarantee of conformity (generally covering defects of conformity appearing within two years from delivery);
- Guarantee against hidden defects under civil law.

Where applicable, we will inform you of the procedures and remedies in our exchanges and/or invoice.

 

10. Reservation of title
The Seller retains ownership of the goods until full payment is received.

 

11. Liability
To the extent permitted by law, the Seller shall not be liable for indirect damages. The Seller’s liability is in any case limited to the amount paid for the concerned order, except where prohibited by law.

 

12. Personal data
Personal data used for orders, invoicing, and customer communications are processed according to our Privacy Policy.

 

13. Governing law and disputes
These CGV are governed by French law. In case of dispute, the parties will seek an amicable solution first. Failing that, the competent French courts shall have jurisdiction, subject to mandatory consumer protections.
